No relief to former Himachal Congress minister in forgery case from HC

Shimla: Himachal Pradesh High Court in it’s decision today refused to stay investigation of a criminal case registered against former Himachal Industry Minister Kuldeep Kumar for offence of cheating and forgery.

Kuldeep KumarThe single bench passed the order on a petition filed by former Industry Minister Kuldeep Kumar for quashing the order of Judicial Magistrate Amb, whereby the magistrate has directed to register an FIR against the petitioner under sections 420, 463, 464, 465, 468, 471 and 474 IPC.

Kuldip Kumar alleged that the complaint was filed with a motive to malign his image and filed only when assembly elections were due in the state.

Earlier Desraj, the complainant had alleged before the judicial magistrate that Kuldeep Kumar belonged to Tarkhan caste as per pedigree table 1913-14.  He alleged that Kumar had got changed his caste in revenue records to Lohar Kaundal. It was alleged in the complaint that Kuldeep Kumar does not belong to scheduled caste and has wrongly taken the benefit of wrong revenue records.

Former minister Kuldeep Kumar contended that he belonged to Lohar caste and a mistake had crept in the revenue records of 1913-14 and the same was corrected by the settlement collector in accordance with law.

Justice Kuldip Singh observed that as the investigation is in the initial stage, without hearing the complainant no interim relief could be granted to the petitioner.

The court listed the case for hearing on Septemebr 17.
